These Terms of Service (“Terms”) govern your use of the website located at localsceneagency.com and any services provided by Local Scene LLC (“Local Scene,” “we,” “us,” or “our”). By accessing or using our website or engaging with our agency, you agree to these Terms.
If you do not agree with these Terms, please do not use our website or services.
1. Overview of Services
Local Scene LLC is a digital marketing agency that specializes in helping local businesses—primarily restaurants—acquire new customers through Google Ads, Meta campaigns, and other customer acquisition systems. All services are offered exclusively on a contract basis.
2. Website Use
Visitors may freely browse the Site without registering or creating an account. We may introduce a members-only area in the future, which would require account creation and authentication. By using the Site, you agree not to misuse or attempt to gain unauthorized access to any restricted areas.
3. Client Engagement & Contracts
All services provided by Local Scene require a signed contract or service agreement. These agreements outline the scope of work, payment terms, and any specific commitments. A minimum commitment of 90 days (3 months) is required unless otherwise specified in the agreement.
Cancellation of services is permitted with a 30-day written notice, in accordance with the signed agreement.
4. Payments
Payments for services may be processed online through Stripe, and are managed via our internal systems, including Go High Level. All payments for the initial 90-day commitment are non-refundable.
Any subsequent billing or service renewals after the initial term must also follow the 30-day cancellation policy.
5. Refund & Cancellation Policy
We do not offer refunds for the first three months of service, as this time is dedicated to strategic buildout and campaign optimization.
Clients may cancel service after the initial term by providing written notice at least 30 days in advance. Details regarding this policy are defined in each client’s signed agreement.
6. Limitation of Liability
As outlined in our client agreements, Local Scene LLC is not liable for:
Budget overages or overspending on ad platforms
Third-party service interruptions or failures (e.g., Google, Meta)
Technical issues or delays caused by vendors or outside platforms
Business performance or sales outcomes resulting from marketing campaigns
All advertising budgets are paid directly by the client to the respective platforms (e.g., Google Ads, Meta Ads), and Local Scene cannot control the delivery or effectiveness of third-party systems.
7. Intellectual Property
All content, systems, processes, and strategies shared by Local Scene—including proprietary advertising methods, copy, and templates—remain the property of Local Scene LLC unless otherwise agreed upon in writing. Unauthorized reproduction, distribution, or sharing of our intellectual property is prohibited.
8. Termination
We reserve the right to suspend or terminate service or site access to any user or client who violates these Terms or any provisions outlined in their contract.
9. Governing Law
These Terms and all business activities of Local Scene LLC are governed by the laws of the State of Texas. Any disputes will be subject to the exclusive jurisdiction of courts located in Texas, unless otherwise defined in the service agreement.
10. Changes to These Terms
We may update these Terms periodically. When we do, the “Effective Date” at the top of the page will be updated. Your continued use of the website or our services constitutes acceptance of any revised Terms.
